Lifetime Labor Warranty
This is a labor warranty provided by Floored New York LLC to you, the original purchaser (“Owner”). This warranty covers labor only. It does not take the place of or affect the manufacturer’s warranty on the material used. Please consult your third-party manufacturer warranties for further coverage.
Warranty
Floored New York LLC warrants to the Owner that the work performed by Floored New York LLC will be free of defects due to workmanship for as long as Owner owns and resides in the home where Floored New York LLC performed the installation, subject to the other terms and conditions contained in this warranty.
What is Not Covered
Floored New York LLC grants this warranty to the Owner only and only materials purchased from and installed by Floored New York LLC are covered by this warranty. This warranty assumes normal and reasonable use of products or components. This warranty does not cover any other damage or material failure including, but not limited to, damage caused by existing defects at Owner’s property or existing underlayment not installed by Floored New York LLC, damage caused by occurrences beyond the control of Floored New York LLC, such as acts of God, settlement of the building, failure of the structure (including foundations and walls), use of incompatible accessories, removal, repair, or re-installation of any products or components by other than Floored New York LLC, normal corrosive effects of chemicals, intentional acts, or unreasonable use or failure to provide reasonable maintenance as and when necessary. For vinyl, wood, tile, stone, and laminate installations, this warranty does not cover discoloration from asphalt driveways, indentations from high heels, scratches and damage caused by chairs, tables, appliances, wheelchairs or motorized scooters, pets, and other tangible objects. Installation, removal, repair, adjustment, tampering, or re-installation of any products or components by other than Floored New York LLC voids this warranty, and Floored New York LLC expressly disclaims any liability for any costs, defects, or damages with respect to such actions. Owner acknowledges that professionally installed carpet may require re-stretching after approximately 24 months, that such is a part of normal maintenance, and such is not covered by this warranty.
How to Obtain Warranty Service
To submit a claim, a copy of this warranty and a copy of the Owner’s sales contract must be submitted in writing by U.S. mail or nationally recognized overnight delivery service to Floored New York LLC, 71 Jane Street, Roslyn Heights NY 11577 with a brief explanation of the claim. Claims must be submitted promptly after discovery of the claimed defect. Within a reasonable period after having received the Owner’s claim, Floored New York LLC will schedule an appointment to inspect the premises and the warranty claim. Starting two years after the inception date of coverage under this warranty, Floored New York LLC will charge Owner and Owner agrees to pay a $50 warranty processing fee for each asserted claim. If after inspection of an alleged claim, Floored New York LLC determines that a valid claim exists, Floored New York LLC will repair, re-install, replace, or refund the purchase price of the failing service, at our option. If Floored New York LLC decides to replace any or all product(s), and if such product(s), as originally installed, is no longer available, Floored New York LLC shall have the right to substitute product(s) designated by Floored New York LLC to be of equal quality. If, at Floored New York LLC’s option, a purchase price refund is conveyed to the Owner, then this warranty is terminated, and the repair, replacement, or removal of the product shall become the sole responsibility of the Owner. This warranty is not valid unless and until the Owner has made full payment under the original sales contract and all addenda thereto. Non-warranty calls for repair or adjustment or calls under a third-party product and/or manufacturer warranty (i.e., claims not related to this labor warranty) may result in a service charge.
Remedies and Rights
This warranty is the only express warranty provided by Floored New York LLC. No employee, representative, agent, or any other person, has authority to assume or incur on behalf of Floored New York LLC any obligation, liability, or responsibility in place of or in addition to this warranty. Floored New York LLC HEREBY EXCLUDES AND DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BY WAY OF ILLUSTRATION AND NOT LIMITATION, WARRANTIES OF FITNESS FOR PARTICULAR PURPOSE, HABITABILITY, AND MERCHANTABILITY. Floored New York LLC’s liability to the Owner under this warranty is limited to the amounts received by Floored New York LLC for services rendered under the sales contract with the Owner. In no event shall Floored New York LLC be obligated or liable for incidental, special, indirect, or consequential damages of any kind for the breach of any express or implied warranty.
